The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 470, 471 and 120B of the Indian Penal Code.
It is alleged that petitioner no. 2 executed a sale deed on the basis of forged power of attorney with regard to the land of the informant in favour of his wife petitioner no. 1. It is submitted by learned counsel for the petitioners that with regard to the land in question power of
Patna High Court Cr.Misc. No.16206 of 2013 (07) dt.13-04-2015 2/2 attorney was executed by landlord Shekh Arif Imam Shahi on 04.02.2012, consequently the sale deed was executed on the basis of said power of attorney on 12.10.2012. The vendor of petitioner no. 2 purchased the said land in 1989. Though, a title suit with regard to the land in question has been filed vide Title Suit No. 14 of 2013 in which petitioner no. 2 as well as his vendor are defendants.
Considering the nature of accusation in the background of dispute with regard to the title of a land in question, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
