The petitioner has preferred this application for grant of regular bail in a case registered under sections 461 and 379 of the Indian Penal Code.

As per the prosecution case, the informant discovered the lock of the shutter of his shop to have been broken and goods worth Rs.9 lacs missing.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Sanjay Kumar made before police. The said Sanjay Kumar has been enlarged on bail vide order dated 15.11.2021 passed in Cr. Misc. no.45237 of 2021. No incriminating article has been recovered from the possession of the petitioner who is in

Patna High Court CR. MISC. No.52513 of 2021(2) dt.09-03-2022 2/2 custody since 6.6.2021 and chargesheet has been submitted in the case.

The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner also confessed to have committed the crime.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to the above named co-accused Sanjay Kumar on whose confessional statement, the name of the petitioner transpired including the petitioner having remained in custody for 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Supaul P.S. Case no.368 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
