JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks regular bail in connection with Amba P.S. Case No. 63 of 2013, registered for offences punishable under Sections 147, 148, 149, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per F.I.R. is that when the informant was sitting at a mobile shop, then two persons came and fired upon him and thereafter 20-25 persons also came and fired. Submission of learned counsel for the petitioner is that he is not named in the F.I.R. and has falsely been implicated in this case. Though, the petitioner is accused in other cases, but in most of the cases he is on bail. Further, he is in judicial custody in this case since 05.01.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court Cr.Misc. No.57323 of 2018(4) dt.05-12-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Amba P.S. Case No. 63 of 2013, subject to the condition that one of the bailors shall be his close relative having sufficient property within the jurisdiction of the court concerned and petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
