JUSTICE RAKESH KUMAR ORAL ORDER 05-03-2019 The sole petitioner, apprehending his arrest in Complaint Case No. 2333(C) of 2016 for offence under Sections 406, 323, 504, 417 of the Indian Penal Code, has prayed for grant of bail in the event of her arrest or surrender. By order dated 17-12-2018, a coordinate Bench of this Court had directed for issuance of notice to complainant/opposite party no. 2 and in the meanwhile, it was directed not to take any coercive action against the petitioner. Office note suggests that opposite party no. 2 has already entered appearance, however; on call, none appeared on behalf of opposite party no. 2.

On going through the complaint petition, I find that it

Patna High Court CR. MISC. No.63055 of 2018(4) dt.05-03-2019 2/2 is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Nisha Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Begusarai in connection with Complaint Case No. 2333C of 2016, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.
