JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-06-2018 This writ petition was earlier dismissed for nonprosecution on 11.07.2011. It appears that MJC No. 3146 of 2011 was filed for restoration of the present writ application and the same was allowed vide order dated 8.9.2017 and the present writ application was restored to its original file. Considering the gap of nearly 10 years and reluctance of the counsel for the petitioner to assist the court, it appears that petitioner has lost interest in pursuing the present writ application and that is why no one appeared Yesterday when the

Patna High Court CWJC No.4693 of 2008(4) dt.20-06-2018 2/2 case was called out and as a matter of last indulgence the case was listed today under the heading for "dismissal" so that one more opportunity may be made available to the petitioner. Today when the case is called out, no one appears on behalf of the petitioner.

Under the aforesaid circumstances, the court is of the view that the petitioner has lost interest in the present writ application and as such there is no point to keep the 10 years old matter pending any further. Accordingly, the writ application is dismissed. In case the petitioner has any substantive grievance, he may raise the same before appropriate forum/court. (Anil Kumar Upadhyay, J) Ravi/- U
