The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 32 of 2019 registered under Sections 341, 342, 323, 379, 384, 504 and 506/34 of the Indian Penal Code.

The accusation is that ten persons named in the F.I.R. including the petitioner came near the informant having armed with lathi, farsa and iron rod and started to abuse and assaulted through fist and slaps. Thereafter, on the order of Sanjit Saraf and Dibakar Giri, Sanjit Saraf pushed him whereas Diwakar Giri and Sohrai Mian caused injury through iron rod. Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act has been attributed against him but due to land dispute, the present case has been lodged with false allegation and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 32 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
