JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 302/120(B)/34 of the Indian Penal Code.
Allegation in brief is that the call was received by the informant from his son, who was in his in-laws' house telling that his in-laws including other family members have cut the vein of his wrist and neck thereafter, the informant reached there but accused persons did not allow him to take the injured to hospital. It is submitted that the petitioner is cousin of the deceased wife moreover he and his father has no concern with the family affairs of the father-in-law of the deceased and the petitioner is an engineering student and he was not in the village,
Patna High Court Cr.Misc. No.32424 of 2016 (4) dt.09-02-2017 2/2 which transpired from paragraphs 37 to 40 of the case diary and on considering these paragraph of case diary the petitioner's father was granted regular bail by this Court. This petitioner merely being cousin of the deceased wife has been implicated in this case moreover he has got no criminal antecedent.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Deepak Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, J.M. Ist Class, Danapur, Patna in connection with Bikram P.S. Case No.78 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
