The petitioner apprehends arrest in relation to Marhoura P.S. case No.21 of 2016 registered under Sections 272, 273/34 of the Indian Penal Code and Section 47(A) of the Excise Act.
As per the First Information Report, it is alleged that a pickup van was intercepted by the police on 19.1.2016 loaded with 11 drums of spirit. On being asked, the driver disclosed that it was to be allegedly unloaded by the petitioner's premises. Admittedly petitioner was neither there nor petitioner knows anything about it nor spirit had been delivered to the petitioner. From the alleged statement of the driver petitioner has been made

Be that as it may, the petitioner above named, in the event of arrest or surrender in the court below within five weeks from the date of receipt/production of a copy of this order, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Chapra, Saran in connection with Marhoura P.S. case No.21 of 2016, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
