This is an application for bail in connection with Akbarpur P.S. Case No. 167 of 2017 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 400 litres of liquor from the house of co-accused and petitioner has been arrested at the spot. Submission of learned counsel for the petitioner is that he has nothing to do with the seized articles and he is in custody since 11.8.2017 having no criminal antecedent.

Heard learned APP also.

Having heard both sides and in view of the recovery of huge quantity of liquor, I am not inclined to grant bail to the

Patna High Court Cr.Misc. No.49237 of 2017 (2) dt.13-10-2017 2/2 petitioner at this stage.

However, learned trial court is directed that once charge has been framed in this case or petitioner completes further two months period in judicial custody, whichever is earlier, the trial court will release the petitioner on bail to its own satisfaction on the condition that petitioner will co-operate in trial. With the above observation, this application is disposed of.
