Petitioner seeks bail in Rafiganj P.S. Case No.50 of 2014 instituted for the offence under Section(s) 307 Indian Penal Code, Section 4/5 of the Explosives Substance Act, Section Sections 150/152 of the Indian Railways Act and Section17 of the CLA Act.

Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner in the written report. He has been made accused merely on suspicion because he has got criminal antecedents.

In the written report, it is alleged that police got confidential information that 20-25 miscreants under the

Patna High Court CR. MISC. No.41924 of 2019(2) dt.11-07-2019 2/2 leadership of Tyagi Ji @ Baba @ Chandeshwar Rajak are planning to blow railway track and cause damage to railway property.

Counsel for the petitioner further submits that coaccused have been granted regular bail by co-ordinate Benches of this Court vie Annexure-2 series.

Petitioner is in custody since 13.06.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S. Case No.50 of 2014, subject to the condition that both the bailors shall be close relative of the petitioner.
