====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 24-07-2023 Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Belaganj P.S. Case No. 334 of 2023 dated 24.05.2023 registered for the offences punishable under Sections 8 and 20(b)(iii)(A) of the NDPS Act.

3. The main submissions advanced by learned counsel for the petitioner are that the petitioner has fair and clean antecedent and as per the allegation, only 250 gm of Ganja like substance is stated to have been recovered from a small shop of the petitioner and the said alleged contraband falls under the purview of small quantity and moreover, the alleged recovery was made before the police personnel as there was no independent witness of the alleged recovery and the petitioner

Patna High Court CR. MISC. No.43992 of 2023(2) dt.24-07-2023 2/2 has been languishing in jail since 25.05.2023.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Belaganj P.S. Case No. 334 of 2023.
