NILU AGRAWAL ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Warsaliganj P. S. Case No. 263/2015 registered for the offence punishable under Sections 147, 148, 149, 323, 341, 353, 504, 505 and 290 of the Indian Penal Code.
The prosecution case is that on 29.09.2015 while Hon'ble Chief Minister was giving his speech on the ground of Mafi Garh under Warsaliganj P.S., some 20-25 unsocial elements disrupted and indulged in assault, out of those persons, three were caught, who named the petitioner and some other. It has been submitted by the learned counsel for the petitioner that he is innocent and there was a large number of persons present and the

No.34744 of 2016 (2) dt.29-08-2016 2/2 allegation upon the petitioner is general and omnibus It has also been submitted that the petitioner has been implicated only on the basis of suspicion and that he has no criminal antecedent, as is evident from para-3 of this application.
However, learned A.P.P. for the State submits that the petitioner is named by the apprehended co-accused person, hence, opposes the prayer for bail.
Be that as it may, since there is general and omnibus allegation, let the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Warsaliganj P.S.Case No. 263/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
