The petitioner seeks regular bail in connection with Belhar PS case no. 293 of 2015 registered for the offences punishable under Section 364/34 of Indian Penal Code. The case of the prosecution is that the accused persons came at the house of the informant and engaged in assault whereafter, the son of the informant was kidnapped. The learned counsel for the petitioner submits that the petitioner has been implicated on account of admitted land dispute, the petitioner does not have any criminal antecedent, is in custody since 31.05.2017 and similarly situated co-accused person has already been granted bail by this Court vide order dated 06.07.2017 passed in Cr. Misc. no. 28023 of 2017. It is further submitted that the son of the informant had returned back on the
Patna High Court Cr.Misc. No.39406 of 2017 (2) dt.19-08-2017 2/2 same day without having any injury.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Banka in connection with Belhar PS case no. 293 of 2015.
