The petitioner seeks bail in Pakribarawan P.S. case no. 125 of 2019 instituted for the offence under Section(s) 376, 511/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for petitioner submits that from the written report itself it would appear that informant has alleged that petitioner with other accused persons snatched her mobile phone. It is further alleged that petitioner took her forcibly to lonely place and committed rape with her. Similar statement was made by the victim in her statement given U/s 164 Cr.P.C which is recorded in para 32 of the case diary. Patna High Court CR. MISC. No.39650 of 2019(3) dt.26-08-2019 2/2 33 of the case diary. The counsel for petitioner has submitted that occurrence took place due to snatching of mobile. The informant has falsely implicated this petitioner by making serious allegation against him.

Petitioner is in custody since 26.4.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge cum Special Judge, Nawada, in connection with Pakribarawan P.S. case no. 125 of 2019, Special POCSO case no. 26 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
