JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sadar P.S. Case No. 651 of 2018 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

Prosecution case as per FIR is that daughter of informant was not found at night and later on phone she informed the informant that she was with the petitioner and did not worry about and thereafter informant contacted the family members of the petitioners and they told her that both are in love affairs and they have gone to live together and later on the victim in her statement has supported the prosecution case. Submission of learned counsel for the petitioner is that there was love affair between them from before, which will appear in the investigation also and thereafter on the pressure of

Patna High Court CR. MISC. No.39562 of 2019(5) dt.26-09-2019 2/2 her parents she has deposed against the petitioner. It is also submitted that they have already married before Notari Public and he undertakes not to tamper with the evidence and threat the girl, including her family members.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Sadar P.S. Case No. 651 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner will not in any threat the victim girl as well as her family members.
