The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/ 148/149/341/352/333/332/353/307/504/506/427/379/115/290/386 of the Indian Penal Code, Section 27 of the Arms Act and Section 40 of Bihar Minor Mineral Concession Rules, 1972. Learned counsel for the petitioner submits that general and omnibus allegations have been levelled against the petitioner that he had also participated in intimidating the Police Officer who had apprehended some persons who were responsible for illegal mining of sand. It is submitted that the petitioner is just a villager and has no role to play in the said occurrence. Considering the aforementioned facts and circumstances,
Patna High Court Cr.Misc. No.50389 of 2015 (3) dt.19-01-2016 P2/2 the nature of allegations and also the fact that the petitioner has no criminal antecedent, let the petitioner Upendra Singh, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Hajipur Town P.S. Case No. 474 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
