The petitioner seeks modification of the order dated 23.12.2004 passed in Cr. Misc. No. 36038/2004 by this Court whereby the petitioner was granted privilege of anticipatory bail in connection with Complaint Case No. 1044C/2003 and was directed to surrender before the learned Chief Judicial Magistrate, Kaimur at Bhabhua.
It is submitted by the learned counsel for the petitioner that she is married sister-in-law of the complainant and living at Jaunpur in U.P. It is submitted that she was not informed about the order passed by this Court in the aforesaid case by her father and mother, who were also made an accused by the complainant. It is also submitted that during the course of time, mother and father of the petitioner also died, and recently, when process under Section 82 of the Cr. P.C. was ordered on 15.02.2016 she was made aware of the aforesaid case and thereafter, she obtained the
Patna High Court Cr.Misc. No.37761 of 2016 (2) dt.29-09-2016 2/2 certified copy of the order, hence, in such circumstances the petitioner prays for extension of time to surrender before the learned Court below.
Let, petitioner surrender and furnish bail bonds in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Complaint Case No. 1044C/2003 within eight weeks from today. The said order dated 23.12.2004 in the aforesaid case is modified to the extent indicated above. The modification application is allowed.
