ANJANA MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioners, informant and learned counsel appearing on behalf of the State. The petitioners apprehend their arrest in connection with Desri (Chandpura O.P) P.S. Case No. 70 of 2016 for the offences registered under Sections 147, 149, 341, 427, 307, 323, 325, 379 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that the informant's side came and attacked the petitioners. There is case and counter case between the parties with regard to the said occurrence by both the parties and the injuries are said to have been inflicted on both the sides.
Considering the aforesaid facts and circumstances of the case and also the fact that there is history of litigation between the parties and that it was the informant's side who had came to the place of occurrence and attacked the petitioners, let the
Patna High Court Cr.Misc. No.32737 of 2016 (2) dt.02-09-2016 petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st Class, Vaishali at Hajipur, in connection with Desri (Chandpura O.P) P.S. Case No. 70 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
