JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This application, for grant of anticipatory bail, arises out of Barauli P.S. Case No. 63 of 2019, disclosing offences under Sections 414 of the Indian Penal Code and Section 25(1b)a, 26 and 35 of the Arms Act. Allegation is that police while patrolling duty found four persons along with two motorcycle in suspicion condition and seeing the police party, they started fleeing away, however, two of them along with motorcycle were apprehended and two persons succeeded in fleeing away and on search from the apprehended accused, one country made pistal and five live cartridges were recovered and they disclosed the names of petitioner as one of their associates.

Submission of learned counsel for the petitioners is that he has no criminal antecedent and has falsely been

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Gopalganj, in connection with Barauli P.S. Case No. 63 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner will cooperate in investigation and appear before the Investigating Officer as and when required, otherwise, his bail bonds will be cancelled.
