The petitioner in the present case is seeking regular bail in connection with Baniapur P. S. Case No. 136 of 2018 registered for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act.
Learned counsel for the petitioner submits that as per allegations, when the Police party nabbed a truck on a secret information standing near a brick kiln, two persons were arrested, one of them was Vivek Kumar Singh and Jarnal Singh (the petitioner). It is stated that Jarnal Singh disclosed is identity as cleaner-cum-driver of the truck. According to the informant, altogether 2645.05 liters of illicit liquor were concealed under
Patna High Court Cr.Misc. No.51995 of 2018(3) dt.20-09-2018 2/3 the cycle parts loaded on the vehicle.
Learned counsel for the petitioner submits that it has come in the confessional statement of the petitioner that the driver of the vehicle was in touch with the driver of the vehicle, so far as this petitioner is concerned, he was working as Khalashi-cum-co-driver.
Learned counsel for the petitioner submits that the petitioner is in custody since 28.05.2018 and the co-accused Vivek Kumar Singh who was arrested along with this petitioner has been granted privilege of regular bail by a learned coordinate Bench of this Court vide Cr. Misc. No. 40565 of 2018 on 10.07.2018. Investigation in this case is already complete. Learned APP opposed the prayer of bail.
Considering the facts and circumstances of the case wherein the petitioner is said to be a cleaner-cum-co-driver of the vehicle and the co-accused Vivek Kumar Singh has already been granted regular bail by a learned co-ordinate Bench of this Court, let the petitioner Jarnal Singh @ Jarnail Singh @ Jeneral Singh @ Jamal Singh @ Jarnaul Singh be released on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Saran at Chapra in
