JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 401,307364,392,511 and 120B of the Indian Penal Code and sections 25(1-B) a, 26 and 35 of the Arms Act.

On the basis of certain information, raid was laid when Supan Mian, Balinder Sahni, Ajay Singh and Arvind Kumar Singh were apprehended. From the aforesaid apprehended persons arms and ammunitions were recovered. From co accused Arvind keys of two motorcycles were recovered. The apprehended accused admitted that they took the contract of killing Teji Rai and also named other persons including petitioner who escaped from the scene.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.39945 of 2015 (2) dt.05-10-2015 2/2 that on the statement of co accused the petitioner has been roped in the present case and there is no recovery from the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Marhowrah P.S. Case No.4 of 2011 pending in the court of learned C.J.M. Saran at Chapra.

This application is disposed of with the aforesaid observation/direction.
