JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,307,504,333 and 353 of the Indian Penal Code.
The prosecution case is that the informant being S.I. of Police, on information, raided Rakesh betel shop and Rohit betel shop and seized foreign and country made liquor in huge quantity. While seizure was being made, 12 FIR named and 150 unknown attacked the police force, assaulted the constables and broke the glass of the police vehicle.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.39967 of 2015 (2) dt.05-10-2015 2/2 that the accusation is omnibus and general against the mob. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, similarly situated accused Ashok Ojha and others have been granted anticipatory bail vide Cr. Misc. No. 16143 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, East Champaran at Motihari in connection with Dumariaghat P.S. Case No.13 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
