Petitioner seeks bail in a case registered for the offence punishable under Section 366 of the Indian Penal Code. The petitioner is in custody since 06.08.2016. Allegation is of kidnapping to the daughter-in-law of the informant.

The victim, in her statement under Section 164 Cr.P.C., levelled main allegation against the co-accused. Earlier prayer was refused by a Coordinate Bench of this Court in Cr. Misc. No. 40621 of 2016 vide Annexure-1. The report of the learned trial Judge would reveal that the case is at the stage of prosecution evidence. Considering the period already undergone by the

No.39699 of 2017 (3) dt.30-01-2018 2/2 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 08 of 2017 arising out of Mohania Police Station Case No. 359 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
