The petitioner is languishing in custody for the offences punishable under Sections 121/121A/120B of the Indian Penal Code, Sections 25(1-b)a/26/35 of the Arms Act, Sections 16/17/18/19/20/21/22 of the U.A.P.A. Act and Section 17 of the CLA Act.

Name of the petitioner surfaced in the confessional statement of co-accused who were apprehended on suspicion that they were preparing to commit some crime. The petitioner has stated on oath that he has got no criminal antecedent. The petitioner is in custody since 05.01.2019.

Considering the lack of material against the petitioner

Patna High Court CR. MISC. No.38542 of 2020(2) dt.26-02-2021 2/2 for further detention, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Belhar P.S. Case No.127 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

If the Court-below would come to the notice that the petitioner has suppressed criminal antecedent before this Court that would be a ground for cancellation of bail of this petitioner in this case also by the learned Court-below itself. (Birendra Kumar, J) Mkr./- U T
