02. 31.08.2016 Heard parties.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 427, 504 and 506 of the Indian Penal Code. It is contended that the petitioner no. 1, Santan Singh was being victimized for fighting for public cause as he had filed a Public Interest Litigation before this Court for the corruption and malpractice committed by the Mukhiya of Gram Panchayat.

Patna High Court Cr.Misc. No.29664 of 2016 (2) dt.31-08-2016 It is contended that the Informant is agnate of the petitioners and there is a partition suit pending between the parties. After the aforesaid Public Interest Litigation, several cases were filed on behalf of the Informant's side, some of them have been quashed by a Co-ordinate Bench of this Court vide Annexure-6. It is urged that the injuries are simple in nature and there is case and counter-case between the parties.

Having regard to the facts and circumstances of the case, let the petitioners, above named be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Madanpur P.S. Case No. 67/2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
