This application is for grant of regular bail in connection with Hilsa P.S.Case nO.98 of 2017 , registered for the offences punishable under Sections 304B, 498A and 34 of the Indian Penal Code.
Allegation against the petitioner and other co-accused persons is of dowry death. The petitioner is said to be husband. Submission of the learned counsel for the petitioner is that nothing specific has been attributed against the petitioner and further as the petitioner was earlier interested in the property of the petitioner, he filed a Partition Suit and that is why he has been made accused in this case.
Patna High Court Cr.Misc. No.42331 of 2017 (2) dt.12-09-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the deceased prior to death has named the petitioner and other accused persons. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
With the aforesaid observation, this application is dismissed.
