JUSTICE SANJAY PRIYA ORAL ORDER 29-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Karpi P.S. Case No. 121 of 1998 instituted for the offence under Sections 324, 326, 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that petitioner along with 13 other accused persons came in the Dalan of house of the petitioner and made indiscriminate firing causing death of seven family members of the informant including his father and brother. Two family members of the informant have sustained serious injuries.

Report regarding stage of trial has been called for which has been received. From the report it appears that trial has proceeded. Out of 15 charge sheeted witnesses, two witnesses

Patna High Court Cr.Misc. No.52182 of 2018 (4) dt.29-10-2018 2/2 have already been examined.

Considering the serious nature of the offence, this Court is not inclined to grant bail to the petitioner. Therefore, prayer for bail of the petitioner stands rejected.

Court below is directed to expedite the trial and make efforts to conclude the same preferably within a period of nine months from the date of receipt of this order. (Sanjay Priya, J) S.Ali/- U T
