JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Sasaram (Model) P.S. Case No. 651 of 2013, registered for offences punishable under Section 461, 379 and 411 of the Indian Penal Code.
Allegation against the petitioner and others is of committing theft of Rs. 7, 60, 612/- from the almirah of the office of the informant and it is alleged that petitioner was given Rs. 90,000/- out of the said amount from which he purchased a two wheeler.
It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name transpired in this case on confession of co-accused. Further no recovery has been made
from possession of the petitioner and he has been in judicial custody for last seven months.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sasaram at Rohtas, in connection with Sasaram (Model) P.S. Case No. 651 of 2013, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall mark his attendance in the local police station in the first week of each month at least for a period of one year so that the police may watch his conduct.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates
without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
Let a copy of this order be communicated to S.P. of concerned district with liberty to him that if petitioner fails to mark his attendance as directed above, he may move for cancellation of his bail bonds.
