JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Sirdala P.S.Case No. 95 of 2017 instituted for the offences under sections 30 (A) Bihar Prohibition (Amendment) Act, 2016.

It has been submitted that 15 liters mahua wine was seized from the place of occurrence on the basis of secret information. It is also alleged that the petitioner was selling mahua wine and seeing the police party, the petitioner fled away. From the written report, it appears that alleged liquor has not been recovered from the conscious possession or from the house of the petitioner, rather, it has been recovered from the road side and the petitioner is in custody since 15.05.2017.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- II-cum Special Judge, Nawada in connection with Sirdala P.S.Case No. 95 of 2017 subject to the condition that both the bailors will be the close relative of the petitioner.
