For the Petitioner/s : None For the Respondent/s : Mr. Kumar Pankaj, AC to SC 5 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 19-05-2017 The only direction issued by this Court was that as and when an advertisement is issued, looking into the service rendered by the petitioners in the daily wagers capacity and the experience gained by them, the respondents would consider the claim of the petitioners for grant of age relaxation and adequate weightage for the experience gained in accordance with the Rule 54 of the Bihar Service Code.

Inter alia contending that the claim of the petitioners having not been considered, the application has been filed. The respondents point out that till date no advertisement has been issued and as the Court has rejected the claim of the

Patna High Court MJC No.3342 of 2014 (4) dt.19-05-2017 3/3 petitioners for regularisation, no further indulgence into the matter is called for.

Taking note of the detailed order passed by the learned Writ Court and considering the fact that claim of the petitioners for regularisation stood rejected and the only direction was to consider their claim for grant of age relaxation and weightage for the service rendered as daily wagers as and when the advertisement is issued, in the absence of there being any advertisement and the action taken by the Government to fill up the posts, no case for initiating action for contempt is made out. The application is, accordingly, dismissed. (Rajendra Menon, CJ) Sunil/- U
