JUSTICE SUDHIR SINGH ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 307, 337, 338, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he assaulted the informant on his head by means of an iron rod as a result of which he fell unconscious.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. It is a case and counter case between the parties. Injury received from the side of the petitioner has not been explained by the prosecution which creates doubt upon the conduct of the prosecution. The other co-accused have been granted bail vide Cr. Misc. no. 31247 of 2015. On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R. and has actively participated in the alleged occurrence.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.50411 of 2015 (4) dt.09-02-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sumit Kumar Singh, learned Judicial Magistrate, Ist Class, Munger, in connection with Kasim Bazar P.S. Case no. 64 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
