JUSTICE MADHURESH PRASAD ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner, learned counsel for the State as well as learned counsel for the informant.
The petitioner seeks regular bail in a case registered for offence under sections 452, 323, 376, 511, 504 and 506 of the Indian Penal Code.
While forcibly trying to establish physical relation with the informant the petitioner was apprehended at the spot. Petitioner's prayer for bail has earlier been rejected on 26.4.2018.
It is submitted on behalf of the petitioner that now petitioner has remained in custody for more than a year. A report from the court below suggests that 2 out of 10 chargesheeted witnesses have been examined in the court below.
Patna High Court Cr.Misc. No.63109 of 2018(5) dt.30-01-2019 2/2 This Court, in view of serious nature of allegation, is not inclined to allow the petitioner's prayer for bail for the present. Petition for bail is rejected.
