Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Fatehpur P.S. Case No.09 of 2021 registered for the offence punishable under Sections 341, 323, 354-A, 379, 504, 506 and 509 of the Indian Penal Code and under Section 8 of POCSO Act.

The petitioner is said to have outraged the modesty of a 14 years old girl. He has criminal antecedent also. Considering the aforesaid, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail application is dismissed.

Patna High Court CR. MISC. No.52558 of 2021(2) dt.24-05-2022 2/2 The F.I.R. has been registered on 10.01.2021 and it is surprising that the Police has not taken any step for arresting the accused under POCSO Act and he is roaming free in the society.

The petitioner is directed to surrender in the Court below within four weeks from today. If he doe not surrender within the aforesaid period of four weeks, then the Senior Superintendent of Police, Gaya, will take all steps for arresting the petitioner.

Office is directed to send a copy of this order to the Senior Superintendent of Police, Gaya, through FAX or e-mail forthwith.

Learned APP for the State shall also communicate this order to the Senior Superintendent of Police, Gaya, through Phone or WhatsApp immediately.
