KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The Petitioner who is in custody seeks bail in connection with Wazirganj P.S. Case No. 38 of 2017, registered for the offence punishable under Sections 147, 148, 149, 302, 201 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is that he along with other co-accused persons have killed the son of the informant.

It has been submitted on behalf of the petitioner that the name of the petitioner transpired on the confession of co-accused Naresh Yadav @ Naresh and except that there is nothing against the petitioner. It has been further submitted that

Patna High Court Cr.Misc. No.44994 of 2017(3) dt.21-09-2017 2/2 similarly situated co-accused person namely Ashok Kumar Singh @ Dara Singh has been granted bail by a co-ordinate bench of this Court vide order dated 07.09.2017 in Criminal Miscellaneous No. 41267 of 2017. The petitioner has got no criminal antecedent and is in custody since, 01.06.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Gaya in connection with Wazirganj P.S. Case No. 38 of 2017.
