2. The petitioners apprehend their arrest in connection with Singhiya P.S. Case No. 273 of 2023 registered under Sections 147, 148, 149, 341, 323, 324, 354, 307, 379, 448 and 504 of the Indian Penal Code.
3. As per prosecution case, on 10.10.2023 at about 9:00 a.m., co-accused Ram Chandra Manjhi forcibly tried to remove thatch wall of informant, and when mother of informant opposed, then all the F.I.R. named accused persons including these petitioners entered into courtyard of informant with deadly
Patna High Court CR. MISC. No.47738 of 2024(3) dt.23-09-2024 2/3 weapons and started abusing and assaulting informant and his family members. It is further alleged that petitioner no. 1 assaulted on head of Umakant Manjhi with iron rod and petitioners no. 2 and 3 assaulted Arvind Manjhi.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners and informant are agnates and due to dispute over pathway an altercation took place between them. A title suit is also pending between the parties for the said pathway dispute before the learned Sub-Judge, 1st, Rosera. The present case has been lodged after an inordinate delay of more than 20 days. Case and counter case. The injuries allegedly caused by these petitioners are simple in nature. Petitioners no. 1 and 2 have got clean antecedent. Petitioner no. 3 has got one criminal antecedent, in which he is on bail.
5. Learned A.P.P. appearing on behalf of the State opposed the bail application and submits that petitioners are named in the First Information Report. There is specific allegation of assault against these petitioners.
6. Having considered the aforesaid facts and circumstances of the case, delay in lodging the FIR and nature of injuries, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below
Patna High Court CR. MISC. No.47738 of 2024(3) dt.23-09-2024 3/3 within a period of eight weeks from today, on furnishing bailbonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Rosera, Samastipur in connection with Singhiya P.S. Case No. 273 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
