Petitioner apprehends his arrest in connection with Mahila P.S. Case No.21 of 2018 for the offence punishable under Sections 323, 341, 498(A), 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
The petitioner is husband of Opposite Party No.2 The matter was referred for Mediation before the Patna High Court Mediation Centre and the report of learned Mediator dated 13.08.2019 along with terms and conditions of settlement are on record. From perusal of the terms and conditions of agreement dated 13.08.2019, it appears that both the parties have agreed to
Patna High Court CR. MISC. No.54600 of 2018(4) dt.16-08-2019 2/2 settle the dispute amicably and a sum of Rs.6,50,000/- has been paid by way of Demand Draft to the Opposite Party No.2 by the petitioner which has been duly acknowledged by Opposite Party No.2.
In view of the fact that the parties have entered into an agreement / settlement before the learned Mediator, as such, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai, subject to the terms and conditions of the agreement dated 13.08.2019.
