The petitioner seeks regular bail in connection with Alam Nagar P.S.Cae No.23 of 2017, registered for offences punishable under Section 376 of the Indian Penal Code.

Allegation against the petitioner is of committing rape upon the informant.

Submission of the learned counsel for the petitioner is that the whole prosecution case is false and concocted and the statement of the girl recorded under Section 164 Cr.P.C. is contradictory and even the medical report appears to be manipulated one. The petitioner is in custody for about five months.

Having heard both sides and in view of allegation, this

Patna High Court Cr.Misc. No.46496 of 2017 (2) dt.20-09-2017 application is disposed of with direction that once the charge is framed, the petitioner may renew his prayer for bail before the court concerned, which will be considered by the learned trial court and will pass appropriate order.

With the aforesaid observation, this application is disposed of.
