Petitioner seeks bail in Alamganj P.S. Case No.155 of 2012 (S. Tr. No.1382 of 2012) instituted for the offence under Section(s) 413, 414/34 Indian Penal Code and Section 25(1-b)a, 26 and 35 of Arms Act.
It is the case of misuse of privilege of bail. In the impugned order, it is mentioned that bail bond of the petitioner was cancelled on 11.07.2013. He was remanded in this case on 07.01.2017 and since then he is in custody. This Court finds that petitioner has sufficiently been punished for the latches committed by him.
In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.59322 of 2018 (3) dt.06-10-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII, Patna City, Patna, in connection with Alamganj P.S. Case No.155 of 2012 (S. Tr. No.1382 of 2012), subject to the condition that both the bailors shall be close relative of the petitioner. The petitioner will remain physically present on each and every date of trial and his absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled.
