2. The petitioner, who is in custody since 19.10.2016, has renewed his prayer for bail in connection with Case No. Spl. (NDPS) 04 of 2016 for the offences alleged under Sections 20(b) of the NDPS Act having earlier been rejected by this Court by order dated 01.05.2018 in Criminal Miscellaneous No. 24635 of 2018.

3. It is submitted that in a subsequent development, similarly situated co-accused Lalita Devi @ Most. Lalita Devi, who was also a co-passenger of the car has been granted bail by this Court on 02.08.2018 in Cr. Misc. No. 46433 of 2018. The only other co-accused Rajeev Kumar, the driver of the vehicle has also been granted bail by this Court on 28.03.2018 in Cr. Misc. No. 10374 of 2018. The petitioner claims clean antecedents.

4. Be that as it may, having regard to the entirety of the

Patna High Court Cr.Misc. No.59360 of 2018(4) dt.02-01-2019 2/2 facts and circumstances of the case and considering the period of custody already suffered since 19.10.2016, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Ist Additional Sessions Judge, Nawada-cum-Special Judge NDPS, Nawada in connection with Case No. Spl. (NDPS) 04 of 2016 on the following conditions:- (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
