The Petitioner seeks regular bail in connection with Sadar P.S.Case No. 548 of 2017, registered for offences punishable under Sections 328 and 379 of the Indian Penal Code. Allegation as per F.I.R. against the petitioner is that the petitioner is not named in the F.I.R. and the name of the petitioner transpires during investigation. It is also alleged that the petitioner is accused in three other cases also. Submission of the learned counsel for the petitioner is that there is nothing against the petitioner and the petitioner has not been put on Test Identification Parade and he is in custody
Patna High Court Cr.Misc. No.56856 of 2018 (3) dt.08-10-2018 2/2 since 12.04.2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above as well as criminal antecedent of the petitioner, I am not inclined to grant privilege of bail to the petitioner with a further direction to the lower court to expedite the trial and conclude the same within a period of seven months after the period of the custody of the petitioner and he shall be released on bail to the satisfaction of trial Court.
With the aforesaid observation, the instant petition is disposed of.
