The petitioner seeks bail in Rani Talab P.S. case No. 13 of 2014, corresponding to Sessions Trial No. 948 of 2014, under Section 302, 120B, 34 of the Indian Penal Code and under Section 27 of the Arms Act.
The prayer of petitioner for bail was earlier rejected by this court vide order dated 16.04.2015 passed in Cr. Misc. No. 49091 of 2014 with a direction to the trial court to conclude the trial within one year but the trial has not yet been concluded. Mr. Yogesh Chandra Verma, the learned senior counsel for the petitioner, submits that, of course, there is allegation against the petitioner that he fired which caused death of the wife of the informant but petitioner has remained in jail for more than two and half years.
The report is received and the learned 4th Additional
Patna High Court Cr.Misc. No.31438 of 2016 (3) dt.21-12-2016 2/2 Sessions Judge, Danapur, Patna has reported that six witnesses have already been examined including the doctor and informant and only I. O. is to be examined.
Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The learned trial court is directed to hold the trial on day to day basis and conclude the same within three months from the date of receipt of this order.
The Senior Superintendent of Police, Patna/ Deputy Superintendent of Police, Danapur is directed to ensure the attendance of Investigating Officer of Rani Talab P.S. case No. 13 of 2014, corresponding to Sessions Trial No. 948 of 2014, in the court of learned 4th Additional Sessions Judge, Danapur, Patna so that the trial must be concluded within three months. Let a copy of this order be sent to the learned trial court as well as Senior Superintendent of Police, Patna/ Deputy Superintendent of Police, Danapur, Patna for information and needful.
