JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2017 The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 39 of 2017, registered for offences punishable under Sections 341, 323, 324, 307, 302 and 34 of Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no allegation against the petitioner of assaulting the deceased rather the allegation against the petitioner is of assaulting other injured person by knife, however, the same is false and concocted as no injury has been sustained by the said person and further no injury report is available. Petitioner has clean antecedent and has been in judicial custody since 15.03.2017.

Having heard both sides, considering the fact and circumstances of the case, this application is disposed of with

Patna High Court Cr.Misc. No.46234 of 2017 (2) dt.20-09-2017 direction to the court below to call for injury report of other injured person of this case and after verification of injury report, if no injury is found on the other injured person as stated by learned counsel for the petitioner, he will release the petitioner on bail to his own satisfaction otherwise he is free to pass any order as he deems fit and proper.
