Since in both the cases the grievance of the petitioners is one and the same hence they have been taken up together and with the consent of the parties they are being finally disposed of at the admission stage itself.
Patna High Court CWJC No.14951 of 2014 (2) dt.15-01-2015 The petitioner(s) of both the writ petitions are holders of licence for running a fair price shop under the public distribution system and their licences have been cancelled under the orders of the Licensing Authority -cum- Sub-Divisional Officer in each of the cases. The petitioners being aggrieved have preferred statutory appeals and their grievance is that their appeal has remained pending.
Whereas in CWJC No.14951 of 2014 the appeal of the petitioner bearing Supply Appeal No.133 of 2011 remains pending for adjudication before the District Magistrate, Saran at Chapra, in CWJC No.17807 of 2014 the appeal filed by the petitioner bearing Appeal Case No.12 of 2014 has remained pending before the District Magistrate, Begusarai. The limited grievance of the petitioners is that no steps have been taken by the appellate authority being District Magistrate concerned in disposing of the appeal(s). Having heard learned counsel for the parties and considering the grievance of the petitioners, the two writ petitions are disposed of with the direction to the appellate authority, i.e. the District Magistrate Saran at Chapra and District Magistrate, Begusarai respectively to consider and dispose of the appeal filed by the petitioners, the details whereof
Patna High Court CWJC No.14951 of 2014 (2) dt.15-01-2015 are mentioned hereinabove, in accordance with law and after giving opportunity of hearing to the petitioner(s) expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
