Petitioner seeks bail in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
The FIR of kidnapping/abduction of the husband of the informant is against co-accused Guddan Mian and others. The petitioner is not named in the FIR.
Submission of the learned counsel for the petitioner is that after five years of the FIR, name of the petitioner transpired only to the extent that he was also involved with Guddan Mian in dealing of the lands.
Learned counsel for the informant opposed the prayer for bail.
Patna High Court Cr.Misc. No.47392 of 2017 (6) dt.30-01-2018 2/2 Considering the aforesaid material as well as the fact that Guddan Mian has already been allowed bail by a Coordinate Bench of this Court vide order dated 20.10.2011 passed in Cr. Misc. No. 45410 of 2010, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hilsa Police Station Case No. 289 of 2010, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
