JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner, learned counsel for the informant and the State.

The petitioner seeks bail in Kashichak P.S. Case No. 88 of 2018 instituted for the offence under Sections 302 and 201 of the Indian Penal Code.

It is alleged in the written report that dead body of brother of the informant was found near Bridge. Case diary has been received.

Post mortem report is available in the case diary wherein the Doctor has opined the cause of death due to burn by electric current.

Counsel for the petitioner submits that petitioner is not named in the written report. His name has come in the

Patna High Court Cr.Misc. No.54863 of 2018 (3) dt.10-10-2018 2/2 confessional statement of co-accused Pappu Kumar. Petitioner is said to be in custody since 9.7.2018. Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Nawadah, in connection with Kashichak P.S. Case No. 88 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
