2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 143, 353, 332 and 333 of the Indian Penal Code.
3. As per the prosecution case, petitioner along with other co-accused persons pelted stones, bricks etc. on the police party due to which some of the police personnel got injured and also got freed co-accused Rajiv Kumar Singh from the custody of police.
4. It is submitted that there is general and omnibus allegation. No specific overt act has been alleged against this petitioner. Petitioner is a student and he has been falsely implicated in this case. Similarly situated co-accused have been
Patna High Court CR. MISC. No.45865 of 2023(2) dt.10-08-2023 2/2 granted bail by this Court vide Annexure-2 series.
5. Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Mashrakh P.S. Case No. 88 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
