This is an application for bail in connection with Puraini P.S.Case No. 66 of 2016 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. Petitioner is named in the FIR and the case is under the Arms Act.
Submission of learned counsel for the petitioner is that FIR itself shows that name of the petitioner has been disclosed by other accused person and there is no recovery from his possession and thereafter he has been remanded in this case and he is in custody since 30.6.2016.
Heard learned APP also.
Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.53222 of 2017 (3) dt.17-11-2017 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Uda Kishunganj, Madhepura, in connection with Puraini P.S.Case No. 66 of 2016, subject to the following conditions :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month at least for a period of one year, so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.
Let this order be communicated to the Superintendent of Police, Madhepura for its compliance.
