The petitioner is in custody in a case registered for the offence punishable under Sections 341, 324, 307, 34, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, the informant along with his brother-in-law, namely, Bambam Kumar (deceased) had gone to the market on the occasion of marriage of the informant and while returning two motorcycle borne accused persons intercepted them and opened fire upon the deceased causing injury to him and later on succumbed to the injury. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further

Patna High Court CR. MISC. No.42168 of 2022(3) dt.09-01-2023 2/2 submits that co-accused Komal Kumari @ Raja has been granted regular bail by this Court passed in Cr. Misc. No. 26730 of 2022. Petitioner is in judicial custody since 16.01.2022. Learned APP appearing for the State has opposed the prayer for regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai Town P.S.
