The petitioner seeks bail in a case instituted for the offences under Sections 385, 386, 387, 427, 120(B)/34 of the Indian Penal Code.

Prosecution allegation, in short, is that the informant being a property dealer was receiving threats from accused persons to pay a sum of Rs. 20 lacs and one katha land. It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.9.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Due to previous enmity, the present case has been instituted. As per allegation, 20 lakhs along with one katha land

Patna High Court CR. MISC. No.40336 of 2019(2) dt.02-07-2019 2/2 was demanded. Allegations made in the F.I.R. is denied by the petitioner. Other co-accused has been granted bail vide Annexure-2/1 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XV-cum- A.C.J.M., Patna in connection with Phulwarisharif P.S. Case No. 221/18.
