ANJANA MISHRA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Ghorasahan (Lakhaura) P.S. Case No. 338 of 2014 registered for the offences punishable under Sections 420, 406 and 504 of the Indian Penal Code and under Section 138 of N.I. Act.
Learned counsel for the petitioner submits that the matter was referred to the Patna High Court Mediation Centre in which an agreement was arrived at between the parties. In pursuance of the said agreement, the petitioner has already paid a sum of Rs. 80,000/- to the informant and the rest amount of Rs.
Patna High Court Cr.Misc. No.47653 of 2015 (5) dt.19-04-2016 5000/- has also been paid to him as per terms and agreement. Learned counsel for the informant is not present today.
In view of the submission made on behalf of learned counsel for the petitioner, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Ghorasahan (Lakhaura) P.S. Case No. 338 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is made clear that the petitioner shall produce the relevant receipts regarding payment made to the informant at the time of filing of his bail bonds so as to facilitate the Court to ascertain the same.
The mediation report is kept on record and shall reiterate as the terms of agreement.
